I found the actual opinion online, versus a synopsis. This is absolutely not praise of Ken Paxton (Paxton's "statement" which is different than his legal opinion, really lets you know how he's wanting all this go), Governor Abbott, or the situation in Texas, but it's a fascinating read of a lawyer on a tightrope doing legalistic gymnastics to entertain two diametrically opposed audiences.

Date: 2015-06-29 07:14 pm (UTC)Still, I view this as the death throes of such discrimination, with politicians here and there quietly signaling as much, even where they may try to toss red meat to the base. Not that that means we can lighten up in our defense of our common human rights, but as Nate Silver's recent column demonstrated ably - the path ahead is clear, and it's not in their favor. ^_^ It's not merely generational turnover, as he so delicately puts it, but actually minds being changed - a far better basis for such societal change, for all the conservatives' blustering of "activist judges", as it demonstrates they're merely catching up.
