Jennifer,

I just received word about the "incident" today. I'm not really sure what to
say. I'm a very liberal, open minded person, and I certainly don't think
it's fair to discriminate against anyone for any reason.

However, this "bathroom" situation caused quite a stir, and needless to say,
it's a very negative reflection on my company. I know it's a complicated
situation, but most of the agencies, including [Company] have firm policies
about "transgendered" employees. I'm not even sure if that's the proper term
for someone in "transition," however [Company] has very fair policies concerning
this. You could have easily kept your job and enjoyed a rewarding
experience. But it comes down to what the "plumbing" is downstairs. I have
no idea what your situation is, and it's none of my business, but if you are
still a man below the belt, they want you to use the men's facilities.

At any rate, [company] isn't going to pay us for your morning of work. So I hope
you will understand why I won't be able to pay you for your time.

I wish this would have worked out, but things happen. Next time around, I
would suggest being more honest with your prospective employer before
accepting a position in order to avoid unexpected complications.

I appreciate that position. However, as a transitioning transgender, I
expect to be treated as a woman. I realize some places aren't able to
deal with such thing, and have policies that conflict with transgenders.
As women may feel threatened at me using a women's restroom, I will feel
threatened at usiing a male's.

This is not my first job as a female. This was never a problem with Dell
or Kinko's, Dell even backing me in a HR issue on the matter.

I have NEVER been less than honest. My name is my name, my presentation
is my presentation. And frankly, I find this last paragraph insulting.
What is between my legs is not important in the workplace, and is
therefore never mentioned.

I'm not trying to talk you into doing something, just pointing out something.

You were working for, IIRC, a branch of the state government or someone working directly for them, correct? If so, it seems to me to be a really bad precedent to let them get away with this.

The whole thing sucks, anyway. Dammit.

I've already done the EEOC filing thing. They won't do anything for me since I'm not covered under EEOC.

If I am unhirable, I should at least get some sort of disability.

OMFG. That is so wrong. You should file a massive lawsuit and squeeze every penny from their cold, decaying bodies.

The writer says that he/she is not descriminating, but I think that they are.

And what I want to know is how they think that a woman would be bothered by it, being that all women's restrooms are equipped with stalls?

Anyway, *loads glock ;) aims at target company executive...* you have my backing and support on this %100 percent.

I hate that (that it's legal). But, less than half a century ago, it was legal to kick someone out of a restraunt because they were black. So hopefully, things will change; laws will change, and you will be able to live your life without having to put up with this bullsh*t.

Ah! Okay. Yeah, I've noticed that at the same times of year, shtuph happens again o.O weird.

Awe, come on! You could go into a ladies' room and sit on the toilet and refuse to move. XD! Or maybe switch the signs on all the restrooms (put the male on the female door and vice versa) and see how it f*cks with people's heads. It would be fun. =D

I wish there was something that could be done. Don't they realize that, either bathroom you use, you're screwed? This could easily have been some guy saying he was uncomfortable with someone transgendered in a man's bathroom, and they don't realize this.

You present yourself as a woman and you are in almost every regard a woman. This note should really be proof that this is highly illegal firing.

Unfortunately discrimination is legal against us, as I learned when I filed an EEOC and OSHA complaint agains Harte Hanks. They basically attempted to laugh me out of the office. And when that didn't work, they took my case and told me I'm not covered under the EEOC.

As for how they feel threatened, there are stalls everywhere. What super female secret will I tattle about? How we do our make up?

This is not the first time it's happened, and will not be the last time.

Can you appeal based on the 'sexual harassment' claim? I mean, it is a pretty specific claim. To me, sexual harassment implies a speicific complaint about a deliberate act of a sexually inappropriate nature carried out against a specific person or group.

Hell, I know bugger all about transgender stuff. It just seems like there should be a law against this kind of treatment. But then again, I also think there should be a law against stupid people breeding...

Transgender anti-descrimination laws are being passed on a state by state basis. We just got some protection here in California when transgendered was added to the basic anit-discrimination laws. Also several cities and counties have passed laws to ban exeactly the sort of bias that got you fired. http://www.pissr.org/mission.html is an orginization working to spread that protection nationwide.

The letter from the bastards was one of the most smary, self-justifying bits of crap I have ever read. As for not even paying you for the work you did amy they get the sex lives they so richly deserve (a old Hollywood curse).
